Trump evokes Alien Enemies Act to crack down on Venezuelan gang members

President Donald Trump recently invoked the rarely-used Alien Enemies Act of 1798 against the Venezuelan gang Tren De Aragua, accusing them of unlawfully infiltrating the United States. This law allows the president to detain and deport migrants from a hostile nation during times of declared war or when a foreign government is invading the U.S. Trump’s proclamation accuses the gang of engaging in irregular warfare and drug trafficking against American citizens. The Secretary of State designated Tren De Aragua as a foreign terrorist organization, and Trump directed federal officials to prepare for the implementation of the act.

Hours before Trump’s proclamation, the ACLU and Democracy Forward filed a lawsuit to prevent the imminent deportation of five Venezuelan men under the Alien Enemies Act. Chief Judge Boasberg issued a temporary restraining order to halt their deportation for at least 14 days. The Trump administration has appealed this decision.

Trump’s use of the law fulfills a campaign promise to target gang members and drug dealers. He is the first president in nearly a century to invoke the Alien Enemies Act, which was last used during World War II to target migrants from Japan, Germany, and Italy. Trump’s use of the law has sparked controversy and legal challenges, with critics arguing that it violates constitutional rights and targets individuals based on their nationality.
