Haitian immigrants file lawsuit to prevent Trump administration from rescinding temporary protection

Three organizations have filed a lawsuit to block the Trump administration’s attempt to end Temporary Protected Status (TPS) for people from Haiti and Venezuela living in the U.S. The administration had rescinded the TPS extension granted under President Biden, requiring Haitians to return by August 3 and Venezuelans by April 2. The lawsuit, filed by Lawyers for Civil Rights, is the first on behalf of Haitians under TPS and challenges the administration’s decision. The lawsuit argues that the administration does not have the authority to revoke the granted TPS extension. The White House has not commented on the lawsuit.

The Boston area is home to a significant Haitian community, with almost 50,000 Haitians residing there. Trump’s derogatory comments about Haiti and African nations have been cited in the lawsuit as evidence of racial bias driving the decision to undermine TPS for Haiti and Venezuela. The lawsuit also highlights Trump’s unfounded claims about Haitian immigrants in Ohio.

The lawsuit is being pursued by immigrant advocacy organizations and four affected individuals, including a real estate broker, a business owner, and a nurse. The community is anxious about the sudden loss of legal status, facing deportation to unstable conditions in Haiti, and finding alternative legal pathways in the U.S. Proponents of the lawsuit argue that Trump does not have the power to deport individuals under TPS before its allotted time and question the racial bias behind the decision to revoke TPS for Haiti and Venezuela.
