The Trump administration is appealing a Maryland federal judge’s ruling that blocked the president’s executive order attempting to end birthright citizenship for those born to parents who are not legally in the country. The appeal, filed with the 4th Circuit Court of Appeals, is the second sought by the administration since the initial order was blocked in court. Judge Deborah Boardman had granted a preliminary injunction in response to a case brought by immigrant rights groups and expectant mothers in Maryland, emphasizing that citizenship is a precious right granted by the 14th Amendment of the Constitution. This appeal is just the latest development in a series of legal battles surrounding the president’s birthright citizenship order, with at least nine lawsuits nationwide challenging its validity.

The lawsuits hinge on the interpretation of the 14th Amendment, which guarantees citizenship to all persons born in the U.S. and subject to its jurisdiction. The administration argues that noncitizens are not subject to U.S. jurisdiction, therefore their children born in the country are not entitled to citizenship. However, previous Supreme Court rulings have determined that the only exceptions to automatic birthright citizenship are children of diplomats, enemies present during hostile occupation, those born on foreign ships, and members of sovereign Native American tribes. Birthright citizenship, known as jus soli, is currently practiced in about 30 countries, including the U.S.

The ongoing legal battles and appeals highlight the contentious debate surrounding immigration policies in the United States and the conflicting interpretations of constitutional rights and obligations.
