The Supreme Court is currently considering a challenge brought by the Biden administration and transgender teens against a Tennessee law that restricts gender transition care for minors. The law, enacted in 2023, bans gender transition surgery, puberty blockers, and hormone therapy for minors. Supporters on both sides gathered outside the court to voice their opinions on the matter.
The challengers argue that the law violates the Constitution’s 14th Amendment by discriminating against transgender patients. They claim that this law is a form of sex discrimination, and that transgender individuals should be treated equally under the law. Major medical organizations support gender-affirming treatments as an effective way to treat gender dysphoria, but some conservative figures, like Alabama’s Attorney General, question these findings.
The Tennessee Attorney General argues that the law is not discrimination but rather a form of medical regulation that applies equally to everyone. They also point to other countries revising their approach to transition treatments for minors as justification for their law. In a related case, the Supreme Court previously allowed Idaho to enforce a similar law, with the three liberal justices dissenting.
The outcome of this case is expected to have a broad impact, as over 20 other states have passed laws similar to Tennessee’s. A ruling is expected by the end of June, and it is possible that the incoming Trump administration could change the federal government’s position on the case before a decision is reached.
