Some Arizona cities, including Scottsdale and Gilbert, are facing challenges in implementing new housing laws set to take effect on Jan. 1. House Majority Leader Leo Biasiucci raised concerns about Scottsdale’s draft ordinances that restrict the reuse of commercial buildings for multifamily housing, circumventing a law he sponsored. The law allows cities to rezone up to 10% of eligible buildings without a public hearing. Gilbert is also considering ways to minimize the impact of the new laws. Additionally, both cities are facing opposition to a law that requires them to allow property owners to build accessory dwelling units. Scottsdale City Council members criticized this law, citing concerns about short-term rentals and public safety. Biasiucci and incoming House Majority Leader Michael Carbone expressed disappointment that the cities did not address their concerns and may file a complaint with the Attorney General if changes are not made before the deadline. The cities are being urged to reconsider their ordinances in line with the legislative intent.
