A federal judge issued a temporary restraining order against Florida’s surgeon general over a television ad supporting a ballot measure for abortion rights in the state. The ad, created by Floridians Protecting Freedom, featured a woman named Caroline with terminal brain cancer who needed an abortion for life-saving treatment. The Florida Department of Health sent cease-and-desist letters to TV stations airing the ad, claiming it was false and dangerous. The campaign ad sought to remove Florida’s six-week abortion ban by adding language to the state’s constitution allowing abortions until fetal viability. Chief U.S. District Judge Mark Walker sided with the plaintiffs, stating that the state’s efforts to censor opposing ads violated the First Amendment. The executive director of the ACLU of Florida expressed satisfaction with the judge’s decision, emphasizing the importance of freedom of speech in elections. The case will continue, with a hearing scheduled for Oct. 29 to discuss a preliminary injunction request.
